Welcome to Aurius ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Aurius mobile application, web dashboard, and related services (collectively, the "Service").
By registering an account, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
We may amend these Terms from time to time. We will post updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
Aurius is a fitness tracking and coaching platform that provides:
Aurius provides the technology platform only. We do not provide in-person or individually tailored medical, nutritional, or fitness advice. Any guidance from coaches using the platform is between you and that coach; Aurius is not a party to that relationship.
You must be at least 18 years old (or the age of majority in your jurisdiction) to register for an account and use the Service. By using the Service, you represent and warrant that you meet this requirement.
You are responsible for providing accurate, current, and complete information when registering and for keeping your account credentials secure. You may not share your account or allow others to use it. You are responsible for all activity under your account.
We may refuse or suspend registration, or terminate accounts, at our discretion, including for breach of these Terms or misuse of the Service.
Subject to your compliance with these Terms and any applicable subscription or plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or professional use (e.g., as a coach or trainee) in accordance with the Service's intended functionality.
You may not copy, modify, distribute, sell, or create derivative works from the Service or its content, nor reverse engineer, decompile, or attempt to extract source code from the Service, except as permitted by applicable law.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
We reserve the right to remove content and suspend or terminate accounts that we reasonably believe violate these Terms or harm other users or the Service.
Where the Service facilitates a relationship between a coach and a trainee (e.g., assigned routines, progress sharing), that relationship is solely between the coach and the trainee. Aurius acts only as a technology provider and is not responsible for the quality, safety, legality, or outcomes of any coaching or training provided through the platform.
Coaches are responsible for their own qualifications, insurance, and compliance with local laws. Trainees use the Service and any coach-provided content at their own risk. Payment or other arrangements between coaches and trainees are between those parties, except where we explicitly facilitate payment (e.g., subscriptions or marketplace purchases).
You consent to the sharing of data necessary for the coach–trainee features (e.g., workout and progress data with your coach) as described in our Privacy Policy.
Certain features may require a paid subscription or one-time purchase. Payment terms, billing cycles, and refund policies will be presented at the point of purchase (e.g., trial periods, plan limits, renewal). By completing a purchase, you agree to the applicable payment terms.
Payments may be processed by third-party providers (e.g., Stripe). We do not store full payment card details. You are responsible for providing accurate billing information and for any fees (e.g., bank or currency conversion fees) that may apply.
Unless otherwise stated, fees are non-refundable. If we offer a refund in a specific situation (e.g., under consumer law or a stated policy), we will process it in accordance with that policy.
The Service is for informational and organizational purposes only. Aurius does not provide medical, nutritional, or professional fitness advice.
Exercise and diet carry inherent risks. Before starting or changing any fitness program or diet, you should consult a qualified healthcare provider, especially if you have or may have any medical condition, are pregnant or breastfeeding, or have known or unknown injuries or limitations.
Workouts, routines, and any content provided through the Service (including by coaches) may not be tailored to your individual health status. You use such content at your own risk. Aurius does not guarantee any particular fitness, health, or weight outcome.
By using the Service, you acknowledge that participation in exercise can lead to injury (e.g., musculoskeletal or cardiovascular), and you assume all risks associated with your use of the Service and any activities you undertake as a result.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability will be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Aurius and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy; (d) any content you submit or share through the Service; or (e) any dispute between you and another user (e.g., a coach or trainee).
The Service, including its design, features, text, graphics, logos, and software, is owned by or licensed to Aurius and protected by intellectual property laws. You do not acquire any ownership rights by using the Service.
You retain ownership of content you create and upload (e.g., workout notes, custom exercises). By submitting content to the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and process that content as necessary to operate and improve the Service and as described in our Privacy Policy.
You represent that you have the right to grant this license and that your content does not infringe any third-party rights.
You may stop using the Service and close your account at any time, subject to any applicable subscription or cancellation terms.
We may suspend or terminate your access to the Service, with or without notice, if we believe you have breached these Terms or for other operational, legal, or safety reasons. Upon termination, your license to use the Service ends, and we may delete or retain your data in accordance with our Privacy Policy and applicable law.
Sections that by their nature should survive (including Limitation of Liability, Indemnity, and Governing Law) will survive termination.
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may also notify you by email or through the Service. Your continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
These Terms are governed by the laws of the jurisdiction in which Aurius operates, without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, except where prohibited by mandatory consumer protection laws in your place of residence.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
